Terms of Service

Please read these Terms of Service ("Terms") carefully before using Curlew (the "Software").

1. Acceptance of Terms

By downloading, installing, or using Curlew (the “Software”), you agree to these Terms. If you do not agree, do not use the Software. If you use the Software on behalf of an organization, you confirm you are authorized to accept these Terms for it.

2. License

Subject to these Terms and the Apple Media Services Terms and Conditions / Licensed Application End User License Agreement that applies to App Store purchases, you are granted a personal, non-exclusive, non-transferable, revocable license to install and use the Software on devices you own or control, for your own personal or internal business use.

The Software and its source code are proprietary. All rights not expressly granted are reserved. You may not copy, modify, distribute, sublicense, sell, rent, or create derivative works of the Software except as permitted by law.

3. Acceptable Use

You agree to use the Software only for lawful purposes and in compliance with applicable laws. You are solely responsible for the requests you send, the systems you target, and the data you handle. In particular, you agree not to use the Software to:

  • Access, test, or send traffic to systems you do not own or have permission to test.
  • Disrupt, overload, or attack any service or network, or violate any third party's rights.
  • Reverse-engineer, decompile, or disassemble the Software, except to the extent applicable law permits despite this restriction.
  • Circumvent subscription or licensing mechanisms.

4. Your Content

You retain all rights in the workspaces, requests, scripts, and other content you create with the Software. Because Curlew is local-first, this content stays on your device and we do not claim any license to it. You are responsible for keeping backups of your data.

5. Subscriptions

Curlew Pro is offered as an auto-renewing subscription through the App Store, with the price and any free trial shown at purchase. Payment is charged to your Apple ID account at confirmation of purchase. The subscription renews automatically unless canceled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends. You can manage or cancel subscriptions in your Apple ID account settings. Refunds are handled by Apple under its policies. Any unused portion of a free trial is forfeited when you purchase a subscription.

6. Third-Party Services

The Software lets you interact with third-party APIs and services. We are not responsible for those services, their availability, or their terms and policies, and you are responsible for complying with them.

7. Updates and Changes

We may update, change, or discontinue features of the Software at any time. We may also revise these Terms; the updated Terms will be posted on this page with a new revision date, and continued use after that date constitutes acceptance.

8. Termination

These Terms apply until terminated. Your rights under them end automatically if you breach them. You may stop using the Software at any time by deleting it and canceling any subscription.

9. Disclaimer of Warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT IT WILL MEET YOUR REQUIREMENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SOFTWARE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW.

11. Governing Law

These Terms are governed by the laws applicable in the developer's place of residence, without regard to conflict-of-law principles. Mandatory consumer protection rights in your country of residence are not affected.
