Welcome to Hopway! By downloading, installing, accessing, or playing the Hopway mobile application (the "Game"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not download or use the Game.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide updated terms on our official website. By continuing to access or use the Game after those revisions become effective, you agree to be bound by the revised terms.
2. License to Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and play the Game on iOS devices that you own or control, solely for your personal, non-commercial entertainment purposes.
You agree not to:
- Copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, transmit, stream, or broadcast the Game.
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Game.
- Exploit the Game for any commercial purpose or run automated scripts or bots in the Game.
- Remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in the Game.
3. Intellectual Property
All rights, title, and interest in and to the Game, including but not limited to any source code, software, designs, layouts, graphics, character designs, levels, sound effects, music, trademarks, and copyrights (collectively, "Intellectual Property"), are owned by us or licensed to us. You acknowledge that you do not acquire any ownership rights by downloading or playing the Game.
"Hopway" and its associated logos are trademarks of the Game developer. You may not use these trademarks without prior written permission.
4. User Conduct & Game Progress
You agree to use the Game in compliance with all applicable local, national, and international laws, rules, and regulations.
Because the Game saves progress locally on your device (using local device storage), we are not responsible for any lost game data, progress, level unlocks, stars, or settings. If you delete the application from your device, your progress will be permanently lost and cannot be recovered.
5. Disclaimer of Warranties
THE GAME IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE GAME WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
YOUR USE OF THE GAME IS ENTIRELY AT YOUR OWN RISK. WE DO NOT WARRANT THAT THE GAME WILL MEET YOUR REQUIREMENTS OR THAT ANY BUGS OR DEFECTS WILL BE CORRECTED.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER, CONTRACTORS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE GAME, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

These Terms shall be governed by and construed in accordance with the laws of the country where the developer resides, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in courts located in that jurisdiction, and the parties hereby consent to personal jurisdiction and venue therein.
