By downloading, installing, accessing, or using HappyWeb (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and HappyWeb. If you are using the App on behalf of a child, you represent that you are the parent or legal guardian and have the authority to agree to these Terms on behalf of the child.

2. Description of Service

HappyWeb is a mobile application designed to provide a safe, parent-controlled browsing experience for children. The App includes the following features:

Parent-controlled website whitelist and blacklist
Time limits and bedtime restrictions
Browsing history tracking
Site access request system
Parent PIN protection for settings
Optional educational content (Word of the Day)

3. Eligibility and Age Requirements

The App is intended for use by children under parental supervision. To use the App:

You must be at least 18 years old to set up and manage parent settings
Children using the App must be supervised by a parent or legal guardian
Parents are responsible for all activities that occur under their account

4. Parental Responsibilities

As a parent or guardian using this App, you agree to:

Set up and maintain appropriate parental controls
Regularly review your child's browsing history
Monitor and approve site access requests
Keep your parent PIN secure and confidential
Ensure the App is used in accordance with these Terms
Supervise your child's use of the App and the internet

Important: This App provides tools to help manage your child's internet access, but it is not a substitute for active parental supervision. You remain responsible for your child's online safety and behavior.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

Attempt to bypass or disable parental controls
Share your parent PIN with children or unauthorized users
Use the App to access illegal or harmful content
Reverse engineer, decompile, or disassemble the App
Modify, adapt, or create derivative works of the App
Use the App in any way that could damage, disable, or impair the App
Remove any copyright, trademark, or other proprietary notices

6. Third-Party Content and Websites

The App uses WebKit to display web content from third-party websites. We do not control, endorse, or assume responsibility for any third-party content, websites, or services accessed through the App.

When your child visits a website through the App, that website's own terms of service and privacy policy apply. We are not responsible for:

The content, accuracy, or opinions expressed on third-party websites
The privacy practices of third-party websites
Any harm or damage resulting from visiting third-party websites
Any transactions between you and third-party websites

7. Content Filtering Limitations

While HappyWeb provides tools to help filter and restrict content, we cannot guarantee that all inappropriate content will be blocked. The effectiveness of content filtering depends on:

The accuracy of your website whitelist and blacklist
The nature of content on third-party websites
Technical limitations of web filtering technology

You acknowledge that no filtering system is 100% effective, and you remain responsible for supervising your child's internet use.

8. Intellectual Property

The App, including its original content, features, and functionality, is owned by HappyWeb and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy, which explains how we collect, use, and protect information when you use the App.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability
Fitness for a particular purpose
Non-infringement
That the App will be uninterrupted, secure, or error-free
That defects will be corrected
That the App is free of viruses or other harmful components

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAPPYWEB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the App
Any unauthorized access to or use of our servers or data
Any bugs, viruses, or other harmful code
Any third-party content accessed through the App
Any conduct or content of third parties

12. Indemnification

You agree to defend, indemnify, and hold harmless HappyWeb and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Any content you or your child accesses through the App

13. Termination

We reserve the right to terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.

You may stop using the App at any time by uninstalling it from your device. Upon termination, your right to use the App will cease immediately.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the App after any revisions become effective, you agree to be bound by the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HappyWeb operates, without regard to its conflict of law provisions.

16. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HappyWeb regarding the use of the App and supersede all prior agreements and understandings.

19. Acknowledgment

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.

These Terms and Conditions are effective as of the date listed above and will remain in effect except with respect to any changes in their provisions in the future, which will be in effect immediately after being posted.
