Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the BrainBubbles mobile application ("App") provided by the developer ("we", "us" or "our").
1. Acceptance of Terms
By downloading, installing or using BrainBubbles, you agree to be bound by these Terms and by Apple's Licensed Application End User License Agreement ("Standard EULA"), which applies to the App. If these Terms and the Standard EULA conflict, the Standard EULA applies. If you do not agree, do not use the App.
2. Family Use
BrainBubbles is made for the whole family. A parent or legal guardian should accept these Terms, set up the App and manage purchases and settings. Younger players may use the App with the permission of, and under the supervision of, a parent or legal guardian, who is responsible for their use of the App.
3. Use of the App
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App in any way that may impair, damage or interfere with the App or any third party;
- Reverse engineer, decompile or attempt to extract the source code of the App;
- Attempt to get around the parental gate, free play limit or subscription checks.
4. Intellectual Property
All content in the App, including but not limited to graphics, logos, design, text, and software, is owned by or licensed to us and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
5. Free Plays and Subscription
The App can be tried with a limited number of free plays. To keep playing all games without limits, you can subscribe to BrainBubbles Plus, an auto-renewing subscription offered monthly or yearly. A free trial may be offered for new subscribers; any unused part of a free trial ends when a subscription is purchased.
- Payment is charged to your Apple Account when you confirm the purchase.
- The subscription renews automatically for the same price and period unless it is canceled at least 24 hours before the end of the current period.
- You can manage or cancel the subscription in your Apple Account settings, or from the Parent Dashboard in the App.
- Prices are shown in the App before you buy and may vary by country.
- Purchases can be restored on another device signed in with the same Apple Account by tapping Restore Purchases.
All purchases are processed by Apple through the App Store and are subject to Apple's terms and conditions. We do not have access to your payment information. Refunds are handled by Apple.
6. Privacy
Your use of the App is also governed by our Privacy Policy, which explains that the App does not collect personal data and keeps family profiles and progress on your device.
7. Third-Party Services
The App does not include third-party analytics, advertising or crash-reporting services. Purchases are handled by Apple, as described above, and Apple's own terms and privacy policy apply to them.
8. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the App will be uninterrupted, error-free, or secure, or that any defects will be corrected. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied.
9. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of or inability to use the App, even if we have been advised of the possibility of such damages.
10. Termination
We may suspend or terminate your access to the App at any time, without prior notice, if you violate these Terms or if we decide to discontinue the App.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
